Anti-Spam Legislation & School Councils
Canada’s Anti-Spam Legislation (CASL) law came into effect on July 1, 2014. This new legislation prohibits the sending of commercial electronic messages to an electronic address (emails, texts, instant messaging via social media such as Facebook or LinkedIn) unless the sender has provided their consent.
Commercial messages include those of School Councils where any kind of fundraising activity is referenced such as purchase of goods or services and advertisements involving third parties. This includes activities such as bake sales, hot lunches, raffles, yearbooks, etc. and other fundraisers.
As a result, School Councils must obtain express consent. This consent cannot be obtained via electronic communication. It must be obtained in writing (sent home by regular mail or with students) and must be safely stored. The sender's request for consent must include an "opt-in" consent, identify the organization seeking consent (and for what purpose), and provide an unsubscribe mechanism on each and every subsequent electronic message (after express consent is obtained). Express consent is valid until it is revoked.
